​General booking conditions

These conditions are applicable between Stilleben AB, Bruksvägen 21, 81695 Åmotsbruk, Sweden (The brandname KABIN Sweden is an entire part of these conditions) and you who books directly or via another entity that agrees to write an agreement with STILLEBEN AB, according to what is written in the booking confirmation. The agreement can include accommodation, transport and other services and products and even a combination of these elements, below called Products.

 

1. Responsible organizor

The responsible organizor is Stilleben AB, www.kabin.nu, Org.nr: 556893-0605. Stilleben AB promotes Products via www.kabin.nu, onlinebooking engines as well at the Stilleben hotel reception counter. The location is responsible for informing you of the information as stipulated in item 10 below and of all major changes of your reservation or changes in the specific booking conditions. For reservations including regular transport specific conditions may apply.


2. Booking and booking confirmation

The booking confirmation contains important information concerning your booking. Be aware that the content in the booking confirmation stipulates the contract conditions. To be able to have an agreement with STILLEBEN AB you need to be 18 years old at the time of booking. When booking as a party, minimum 2 persons should be 18 years old, if no other age limits are mentioned in the booking confirmation. An ID check will be done at check-in and access will only be granted if the guest meets these requirements. You need to verify the booking confirmation by yourself as soon as you have received it. In case of possible mistakes, you need to mention that immediately. You take responsibility about the fact that the information you supply is correct. You will inform us about any food preferences at time of booking so we have the possibility to book the right product for you. Promises made by our booking staff that are of importance need to be mentioned in the booking confirmation so they can be relied on. We do not take responsibility for promises made by a supplier directly to you. Actual check-in and check-out times are mentioned in the booking confirmation. In the rental prices for cottages, costs for cleaning, rental of bedlinnen and towels, babybeds, childseats, toiletpaper, etc are not included if not mentioned in the booking confirmation.

 

3. Binding booking
The booking is binding when STILLEBEN AB has confirmed your booking and when you have paid the agreed confirmation fee within the agreed time frame or the entire sum for the reservation.

 

4. Payment

You shall pay the agreed price at time of booking plus or minus changes in taxes or fees that occurred after booking. Timing and recipient are stipulated in the booking confirmation. For bookings made earlier then 30 days before arrival a confirmation fee (advance payment) of 50% of the reservation shall be paid to STILLEBEN AB immediately by using creditcard payment (VISA or Mastercard). The remaining sum shall be paid no later then 30 days before arrival. For bookings made 30 days or less before arrival the entire sum shall be paid to STILLEBEN AB immediately with creditcard payment (VISA eller Mastercard) online.

The entire payment needs to be done before arrival. We add a booking fee of 100 SEK when booking through our callcenter. Payments through billing will only be done exceptionaly and after specific agreement. A billing fee of 75 SEK will be added in these cases. You will not receive a confirmation that your payment has reached us, but you can verify the payment status through the payment link in the bookingconfirmation.

 

5. Delayed or non-payment
Have you not paid the confirmation fee (to be paid at time of booking) you will receive 1 reminder to execute the payment of the remaining sum via the payment link. Your booking will not be cancelled when your payment has reached STILLEBEN AB at the latest on the date mentioned in the reminder. If you don´t pay within that time frame your reservation will automatically be cancelled as we will consider that you wish to cancel and whereby the booking conditions will be applied. In case of a non-payment NO reminder will be sent. Also when you do not pay the confirmation fee the we will consider this as a cancellation and also in this case the bookingconditions are applicable.

 

6. Change of booking
If you wish to change anything in your booking a handling fee of 150 SEK will be charged. Bare in mind that a change of arrival or departure date is being considered as a cancellation. Only extensions of existing bookings are not seen as a cancellation. Additional costs for transport may apply.

 

7. Cancellation
You can cancel your booking over telephone or, preferably via email to STILLEBEN AB tel: 0046 297 74 3000, email: booking@kabin.nu. Email cancellation is not valid until you have received a written confirmation of the receipt of your cancellation from STILLEBEN AB.

8. Cancellation fee
The below mentioned cancellation fees are applicable if not written differently in your confirmation.


8.1. Cancellation fees

For cancellation up to 90 days before arrival date the fee is equal to 0% of the total sum of the booking. An administration cost of 500 SEK will be deducted from the refunded advance payment.

Cancellation between 89 and 30 before arrival date: A fee of 50% of the entire sum of the reservation is applicable. Less than 30 days before arrival: the entire sum of the reservation is considered as the cancellation fee. Additional fees for booking and changes will never be paid back.

9. Mistakes and complaints

Possible complaints should in the first place be handled directly with the supplier and should be handled immediately. If amendmends or compensation isn´t taken place you can contact STILLEBEN AB on the contact details you find on your booking confirmation. If you refrein from trying to find a solution during your stay or if you have not given the supllier the chance to solve the porblem during your stay your right to receive compensation is no longer applicable. When you are not agreeing to the compensation offered you shall inform STILLEBEN AB within 60 days after your departure.


9.1. Right to discontinue the contract

In the situation that your reservation can not be delivered according to the confirmation of your booking and if no replacement can be found whereby the difference with the original booking is so small that is of no importance to you (e.g. a cottage or hotel with the same standard), you have the right to discontinue this contract and to receive a refund for the value of the booking minus the share of the booking you have used.
To be able to discontinue the contract you should get in contact with STILLEBEN AB on the above mentioned contract details as soon as you can and 3 days after your arrival at the latest.

10. Information from Stilleben AB

You will receive a written confirmation of your booking. You will receive documentation and other information in good time. You will be informed of major changes that influence your booking. You may enter your accommodation as from the check-in time mentioned in your confirmation.


11. Behaviour
You must follow the instructions, guidelines and regulations for the entire journey and the accommodations. You will pay attention that your behaviour is not disturbing or creating damage to the properties you are using. You shall not use the accommodation for any other reason as what is described in the booking (usually leisure purposes) and you will not have more guests in the accommodation as originally agreed on. It is not allowed to invite other guests to camp or reside on the facilities. When you check-out, you will do some basic cleaning of the property (dishes, toilet, garbage…) while STILLEBEN AB usually takes care of the major cleaning. More detailed instructions can be found in the check-in flyer. You take full responsibility for damage created during your stay. If any damage was created before your stay, you shall inform STILLEBEN AB no later than 24 hours after check-in. In the case that you do not follow these guidelines, STILLEBEN AB has the right to charge you for these costs.

12. Termination

When breach the above-mentioned rules and guidelines occurs in such a way, STILLEBEN AB has the right to terminate the agreement. In case of a temporary accommodation also the owner of the accommodation has the right the terminate the contract under the same conditions as STILLEBEN AB. In such a case you will need to leave the accommodation immediately and no refund will be granted, while you will still be responsible to compensate the costs you have created.

 

13. Privacy

When you are paying you also agree that your contact details will be handled by STILLEBEN AB. The goal is to do regular guest adminstration and that STILLEBEN AB has trustworthy ID documentation of its guests in case of an accident and to meet up with cancellation conditions and the administrate possible compensations and or damage. The contact details may also be used to inform insurance companies and payment companies. The guest may also be contacted for market research or for marketing purposes such as a newsletter or brochures. When booking online and also after the journey the guest may receive a follow-up email containing a questionnaire. The client´s comments are of big importance for us. The replies will be part of a larger investigation and will be published as part of that in such a way that they anonymous.

14. Conditions of handover

A handover of a reservation can only occur before the arrival day of the guests and in agreement with STILLEBEN AB. In case of a handover of transportation the transport will need to agree and special conditions may apply.

16. Force Majeure

In the case that a trip/booking could not occur for a reason outside the responsibility of STILLEBEN AB. STILLEBEN AB will try to manage possible risks upfront as much as possible, but sometimes, even when all was done to avoid certain situations and the consequences from it, it may be that STILLEBEN AB is not in control. In such rare situations STILLEBEN AB can not be held responsible and no compensation will be given. The same is the case for STILLEBEN AB suppliers. We reserve the right for changes in the law and price changes that lay outside our control.

17.Disputes

In case of disputes you can contact the General Complaints Board or General Court.

Specific conditions for Packages. Issueer and touroperator: Stilleben AB
 

When the trip is a package the following specific conditions are applicable. In all other cases the above mentioned general booking conditions are applicable. A package is a trip that has been created upfront and that contains different components, such as transport, accommodation or a combination of those elements or another tourist service. Accommodation in combination with guidance, sportsevent, a concert for example can be such a package. This in the condition that the arrangement lasts for at least 24 hours or includes an overnight or when the services are not being sold seperately for prices related to eachother. Rental of accommodation is not a package for example. As an organizer, STILLEBEN AB is in charge of you for what you have to claim as a result of the agreement. The responsibility also applies to such performances to be completed by anyone other than STILLEBEN AB. Information in catalogs, brochures and website is binding on STILLEBEN AB, but may be amended prior to the agreement being made subject to clear upfront reservation and that you are clearly informed of the change. STILLEBEN AB reserves the right to make any printing or correction errors. As a touroperator STILLEBEN AB  shall guarantee:

That you receive a confirmation of your booking and related actions. That the information is given about how the payment should be done, the check-in procedures and other instructions related to the package.
That the package is in line with the descriptions that you have received on the booking confirmation.

 STILLEBEN AB can not be held responsible for information that is provided by third parties outside the knowledge of STILLEBEN AB and that STILLEBEN AB should not be aware of.

Cancellation condition for packages

Cancellations 90 days or more before arrival date: Fee is equal to 0% of the total booking amount.An administration cost of 500 SEK will be deducted from the refunded amount. Cancellation between 89 and 30 days before arrival date: Fee is equal to 50% of the total booking amount. Cancellation less then 30 days before arrival date: Fee is equal to 100% of the total booking amount. Fees for cancellation insurance, change fees, billing fees and booking fess are non refundable.

Change of conditions before departure or cancellation of a package

STILLEBEN AB can change the conditions of a package in your disadvantage only when it´s stated clearly that this may happen. In case of an increase of costs for STILLEBEN AB occurs after the date the contract has become binding, STILLEBEN AB is allowed to charge these additional costs only when they are related to: - changes in transportation costs - changes in taxes or other fees that are related to services part of this package - changes in exchange rates that influence costs for STILLEBEN AB for the package.

 The price may not change during the last 20 days before the arrival date  and changes need to be announced immediately. Also decreases in price of the package will be announced up to 20 days prior to the arrival date. Changes, whether increase or decrease, less than 60 SEK will not be taken into consideration. You may withdraw from the agreement when STILLEBEN AB informs you that they will not fullfill the promised delivery of services and if the breach of agreement is of such importance to you that you can´t agree to it any longer. This is also the case when the booking conditions are changed in your disadvantage. When STILLEBEN AB wants to cancel the agreement or wants to change the bookingconditions, STILLEBEN AB shall inform you as soon as possible and consequently let you know that you can withdraw from the agreement too according to what is written above. You will inform STILLEBEN AB as soon as you can whether you want to withdraw from the agreement or not. If you don´t do that you loose the right to withdraw.

 

Compensation
When you decide to withdraw from the agreement, you have the right to book another package for the same or higher quality in the case that STILLEBEN AB can offer that. When you accept a package for a lower quality you have the right to receive a refund for difference in price. When you decide not to accept an alternative package or when STILLEBEN AB can not offer you an alternative package you will be refunded as soon as possible. The above mentioned clauses also take effect when STILLEBEN AB cancels the package. When you want to use the right to withdraw from the agreement you shall inform STILLEBEN AB as soon as you can, but no later than 3 days after your arrival. If you don´t inform STILLEBEN AB your right to receive any compensation if that is applicable. The right for compensation is not applicable when STILLEBEN AB shows:

  1. That the minimum amount of participants has not been reached and that you have been informed in due time in line with the agreement.

  2. The package could not be executed because of a force majeur, an event that could not be taken into consideration upfront by STILLEBEN AB, even if all measures were taken.

 

When the cancellation depends on a supplier for STILLEBEN AB, than STILLEBEN AB does not have to compensate according to pt. 2 written above when the supplier for STILLEBEN AB is confronted with such a force majeur.

Changes after arrival: When changes after the arrival date take place and an important part of the services can not be offered, than STILLEBEN AB shall offer a valid alternative without extra cost for you.
When such an alternative can not be offered or when you do not accept the alternative for a reasonable cause, than STILLEBEN AB shall, when applicable, offer you without extra costs transport to a location for your return travel or another location you decide. When that location is of lower value you shall be compensated for the difference.

 

Other mistakes

In cases when mistakes happen other then written above, you have the right for a compensation when the mistake is not made by you. You are not entitled to receive a compensation when the mistakes and the consequences are outside the responsibility of STILLEBEN AB or that could be foreseen or avoided by STILLEBEN AB at the time of booking. The same is valid when the mistake is made by a supplier of STILLEBEN AB, or even a supplier of a supplier.


Handover of agreement
You have the possibility to handover your booking to another traveller, but only in agreement with STILLEBEN AB. In certain situations an alternative traveller might be refused or charged to additional costs. Such situations may occur when a supplier requires that, such as transportation companies that STILLEBEN AB has included in the package. You will inform STILLEBEN AB at least 5 days prior to departure and a fee of 150 SEK will be charged by STILLEBEN AB. Consequentely the alternative traveller will be the new owner of the booking/agreement and all clauses related to that will be applicable.

 STILLEBEN AB shall inform you about possible VISA and ID requirements within the EU, but you as a traveller are responsible for taking action to be in line with the formalities.
